We reserve the right to change or terminate our messaging program at any time. We also reserve the right to update these Messaging Terms at any time. Such changes will be effective immediately upon posting. Your continued enrollment following such changes shall constitute your acceptance of such changes.
By clicking on the “accept terms and conditions box” you agree to pay any and all fees agreed by you on the day of acceptance. These fees include but are not limited to all tournament fees and the 3 required players (Classic Package Only), that must pay with each team attending a tournament, and all camp/subscription/membership fees etc. You also understand that if you pay for a team to attend a tournament and do not fulfill the obligations of the Classic Package that you, at the sole discretion of USA Preps LLC, can lose your tournament fee and that no part of it is refundable. It is also understood that if USA Preps LLC or its affiliates determine that you are outside the area allowed for hotel coverage and if you don’t have the required rooms for that given event that you must pay the hotel fee for your team, or at the sole discretion of USA Preps LLC, your team may not be permitted to participate in that or any other upcoming events. If USA Preps LLC does not allow you to participate in that event or any future event it is understood that any monies collected for any events will be forfeited. A valid credit card, debit card, cash, money order, or check may be used to purchase a Product, Good, Service, or Subscription from USA Preps, LLC or its affiliates. The subscriber is responsible for paying all one time and/or periodic subscription/membership fees, and hereby authorizes USA Preps, LLC and its affiliates and payment processor to charge the subscriber's credit card, debit card, or bank account, to pay for the cost of the one time or ongoing tournament/camp/hotel/mandatory camper(s)/mandatory all-star(s)/subscription/or membership fees via electronic payment. You hereby authorize USA Preps, LLC and its affiliates and its payment processor to charge to the credit card you provide to USA Preps, LLC all amounts owed as a result of your registration, enrollment, or use of a Product, Good, Service, and/or Subscription provided by USA Preps, LLC or its affiliates. Tournament registration fees will be paid $100 monthly upon approval until balance has been paid in full. Camp registration fees will be paid $50 monthly upon approval until balance has been paid in full. Payments will be processed between the 1st and 5th day of each month. Payment in full must be received within 45 days of tournament start date. YOU REPRESENT AND WARRANT, UNDER PENALTY OF PERJURY, THAT; (1) THE CREDIT CARD INFORMATION SUPPLIED TO US IS TRUE, CORRECT, AND COMPLETE; (2) PAYMENTS MADE BY YOU WILL BE HONORED BY YOUR CREDIT CARD COMPANY; (3) YOU SHALL PAY FOR ALL CHARGES INCURRED THROUGH YOUR USE OF, REGISTRATION FOR, ENROLLMENT IN, OR SUBSCRIPTION TO ANY OF THE PRODUCTS, GOODS, SERVICES, OR SUBSCRIPTIONS OF USA PREPS, LLC AND/OR USAPREPS.COM; AND (4) WHILE YOU, THE END USER, MAY NOT BE THE CREDIT CARD ACCOUNT HOLDER, YOU ARE AN AUTHORIZED USER OF, OR YOU HAVE PERMISSION TO USE THE CARD BY AN AUTHORIZED USER,(including but not limited to your parent, sibling, other blood relative, or close personal relation). Subscription plans, offerings and length of terms offered may vary by site. Unless specifically stated, subscribers will be automatically renewed for a term equal to the original term upon expiration of the then-current term, and continually thereafter, unless the subscriber terminates the subscription in writing at least 48 hours prior to the renewal date. When termination is requested by a subscriber, there is no refund for any unused portion of the current subscription. Similarly, USA Preps, LLC does not offer refunds for camps or tournaments for any reason once a participant is registered for a camp or tournament. Subscriber acknowledges and agrees that the authorization to charge subscriber's credit card for services shall automatically transfer to any successors or assigns of service for substantially similar services at the same website. Subscriber may not assign or transfer his or her subscription to any other person or entity. Should subscriber request a refund which is denied for a valid reason under these Terms of Service, and should subscriber subsequently file a claim against USA Preps, LLC; USA Preps, LLC shall be entitled to collect from subscriber all costs (including attorney's fees) associated with defending such a claim.
To protect against potential fraud, USA Preps, LLC may take steps to verify the validity of the credit card information you provide to us. The verification process may include debiting an amount between $0.01 and $0.99 from your credit card account and then crediting the same amount back to your credit card or otherwise ceasing the transaction, and also may include asking you to verify the amount debited in order to confirm that you are in possession of your credit card. USA Preps, LLC will only use this process to screen for fraud and will not otherwise debit your credit card account except as part of a transaction conducted through your account for our Service. By providing USA Preps, LLC with your credit card information, you authorize USA Preps, LLC to debit and credit your credit card account for an amount less than one dollar for such verification purposes.
All fees are exclusive of all taxes and/or duties imposed by governing authorities. You are solely responsible for payment of all such taxes and/or duties.
Some USA Preps, LLC sites occasionally offer promotional free trial memberships to their Premium Services. Subscribers that sign up for a free trial membership will be automatically renewed at the normal subscription rate at the end of the trial period, unless the Subscriber cancels at least 48 hours before the end of the trial.
Only one free trial period is allowed per subscriber. Subsequent subscriptions do not qualify for free trials. Some USA Preps, LLC sites may offer coupons or other promotional offers from time to time. In these situations, a special discounted price may be applicable for a term, followed by a higher price after the initial promotional term. By subscribing, you agree that you will be responsible for all payments as specified in the offer, and you agree that USA Preps, LLC may adjust the pricing of such plans, as specified in the offer, promotional materials or coupon, without notice or other communication to you.
We reserve the right to cancel any event for any reason up to 2 weeks before the first day of the event. For example, if the minimum number of participants required or number of college coaches needed for an event is not reached, we may have to cancel it. In this situation, we will inform you as soon as is practical and you will be offered an alternative camp or tournament of comparable value from us, if available. In the event of cancellation of an event, USA Preps, LLC is "without liability." When stated in any provision of this Agreement, "without liability" means there will be no liquidated damages, refunds, attrition fees, termination fees, cancellation fees, rental charges, travel fees and or change fees, service charges, reimbursements, or any direct, indirect, compensatory, consequential, special incidental damages, or any other damages or amounts of any nature whatsoever paid by USA Preps, LLC..
USA Preps, LLC is "without liability" where the performance of our contractual obligations are prevented or affected by 'force majeure'. This means that we will not pay you compensation or refund you any money if we cancel or change the camp, tournament or any part of a USA Preps event in any way because of unusual or unforeseeable circumstances beyond our control. In these conditions 'force majeure' will include (but shall not be limited to), (1) acts of God, (2) war, including armed conflict, threat of war, riot, or civil or political unrest (3) strikes, or labor or industrial disputes at the venue or event area, (4) disease at the venue or in the event area (examples of disease: SARS, Legionnaires), (5) government regulation or advisory (including travel advisory warnings), (6) civil disturbance at the venue or event area (7) terrorist activity threatened or actual and its consequences in the United States as substantiated by governmental warnings or advisory notices, (8) closure of ports or airports, air traffic control delays, technical problems of transport or other circumstances amounting to force majeure, or curtailment of transportation services or facilities which would materially affect attendees from attending the event, (9) natural or nuclear disaster, fire, earthquake, hurricane, rain, hail, lightning, and other acts of nature or adverse weather conditions (10) inclement weather in the event area resulting in the contracted venue being deemed by the venue manager as unusable, (11) shortages or disruption of the electrical power supply causing blackouts or rolling blackouts or other essential utilities in the event area, or (12) cancellation for safety reasons as deemed necessary by any authorized person (USA Preps staff, venue staff, umpire(s)) (13) any other cause reasonably beyond the parties' control (collectively referred to as "occurrences"), making the event commercially impracticable, illegal, or impossible to fully perform under this Agreement as the Parties originally contracted. In such case, USA Preps may terminate this Agreement, without liability.
Each college coach that is listed on the tournament or camp pages of our website has come to the website, filled out the college coaches form, selected the events they wanted to work and instruct. If, by any chance any of the coaches do not show up to work the camp or tournament it is not the responsibility or fault of USA Preps, LLC and you agree to hold USA Preps, LLC and any of its officers, directors, employees, agents and affiliates harmless from any and all damages. In addition, you understand that you are not entitled to any form of a refund or credit if in fact any coach did not show up to work the camp or tournament.
For all players and teams enrolled to participate in a USA Preps event, there will be no refunds or credits for any reason; including, rainout or Force Majeure. USA Preps LLC reserves the right to cancel an event due to inclement weather or in case of force majeure. The definition of inclement weather shall be at the sole discretion of USA Preps LLC, but is generally defined as excessive heat or cold, ice, snow, freezing rain, wind and may include heavy rains prior to or during the event. In case of any force majeure or rainout of event leading to the unavailability of the facility or its field(s) prior to the event starting, USA Preps LLC reserves the right to reschedule the event or to replace it by an equivalent or superior event with no refund permitted. In the event of rescheduling permitted by us, USA Preps LLC will contact you and reschedule you for another available date in that same calendar year. In the case of event refusal of any of the newly proposed events, your event date and experience will be considered completed. In case of inclement conditions occurring after the event has begun, the latter may be temporarily interrupted and moved back later the same day. In case your event cannot be fully completed due to lack of time or continuous adverse conditions, you will not get a refund or credit for the uncompleted portion of your experience. Any delay or timing extension of your experience due to a rain-out or force majeure conditions will not allow for any dispute, discount, refund, credit or rebate.
Anyone is eligible to join our affiliate program. An Affiliate can only use their affiliate link either in e-mail or as an image/text link unless otherwise approved by a member of the usapreps.com affiliate staff. After someone has used your affiliate link to visit our site, you have 30 days for that person to sign up in order to earn a referral fee. The following paragraphs outline provisions for the misuse of an Affiliate's link. Registering as a Usapreps.com Affiliate signifies your acceptance of the terms below. Affiliates are not prohibited from bidding on keywords in any search engine that apply to the USA Preps, LLC trademark or represent any misspellings or permutation of our brand name including, but not limited to: Usapreps.com, USA Preps, LLC, and/or usapreps.com etc. Affiliates either breaching USA Preps, LLC's Terms of Service or behaving in a manner considered wrongful (both determined by USA Preps, LLC) will be warned. Furthermore, USA Preps, LLC holds the right to withhold any and all commissions associated with such Affiliates.
